Trampa Trademark & VESC Tool Discussions (serious)

Not sure if this has been discussed, but has anybody asked Benjamin how much it would cost to license the TM for use? (and if he’s willing to do so)

I’d bet Frank slipped exclusivity in whatever legal agreement they have. It would insane not to, given how trampa is using the TM!

Morals! You complain about other people creating confusion then do it your self. It’s hypocritical the evidence is only a few posts above several people have shown the confusion in this topic recently. You @Trampa Frank have made it wide spread between VESC Open source project and Trampa and false claimed attacking others declaring that it’s for the protection of the project.

The smaller the enterprise the bigger the attack yet the big boys like Maytech and Enertion you just seem to avoide. Bullies like to pick on the small people is that you company policy?

Guys, Trampa did a business decision and they will be in big trouble if it doesn’t pay off. They put everything on the line w/ this whole buying Vedder in order to have solo access to the VESC tm thing.

All this appealing to their senses (legally or morally) just falls on deaf ears. This is purely a money scenario, the decisions have been made. Now Frank has to literally defend it like he’s defending his career.

Fact. Trampa have not followed the VESC TM agreement
Fact. Frank regular jumps down people’s thort for not following it with all sorts of threats and abuse of systems.
Hearsay Trampa have a deal that voids the TM agreement

You joke but theres a very real chance your comment can get them into trouble considering they do explicitly what Frank says he has an issue with earlier in the thread… they dont just say vesc  :man_shrugging:

Imo you should remove this unless thats you… in which case youre playing with fire :joy:

Im not playing with any fire, just your average dude here.
I did remove the post but do not see how it can cause any fire.

I said it here? Frank could pursue action against them, and frank(heh)ly no one deserves that headache.

I mean its a Variable Electronic Speed Controller is it not?
So not harm no foul from my pov.

Nowhere on the page does it say that, and it links a video in which they show the “VESC” explicitly, call it that, and they sell it as a buisness. These are all the same issues Lee had.

Frank keeps it up, the community is going to get some pitch forks.
Im sure things are already in motion to replace a vedder(esc) due to how Frank
handles things.

Id have to look up, but believe ever since I commented with a downloadable pdf of this
thread. Frank has kinda stfu, at least I hope. I plan to send that to a few people who are considering
tramps. EDIT nvm he is still hammering on. FFS

I think he’s good, but does this look the same on your end?

This is how the Official Vendor sells the product, as they should:

This is how they offer the product, incorrectly:

IIRC Frank has been insistent that companies put BASED UPON or BASED ON, instead of just VESC, because he is trying to protect the value of the brand or whatever. Im agree that it could mean something different, and not be the acronym used in all official trampa VESCs, but do you think Frank cares? He sees VESC, he goes and gets it off the page or device.

e: dare I even comment on their Focbox unity listing?? It reads as though its an official vesc, and showboats the fact that Ben Vedder contributed to the FW and GUI… certainly sounds like they want you to think its the real deal

The acronym itself is one of the issues
Someone mentions VESC without the ™, are they referring to:

  • Vedder Endless Sphere Controller
  • Variable Electronic Speed Controller
  • Volvo Experimental Safety Car
  • Something else?

If you ask Frank, he’ll most likely tell you that the VESC acronym always refers to the ™, but who bears the burden of proof?

I havnt seen a case where its NOT the vendors burden :man_shrugging:

Can we start a list?

  • Ackmaniac
  • B-Box
    … etc

I posted this issue earlier. Seems you can say vesc all you want as long as you’re not referring to Benjamin Vedder vesc project

Key is that it’s a word trademark and then it’s an argument of merely descriptive vs suggestive trademark policy.
