That is a screenshot, public! I told that Stewii before he sold stuff, so he can change things a bit.
I see that. But then you said this:
Which has me curious. I guess I just donāt understand how UCDs can be privately disclosed? Iām by no means an expert, just looking to understand better.
Relying upon the design holder to pro-actively seek out & find people who are planning to design similar products seems pretty obfuscated.
This is of real value, thanks for reminding us (me?) of this. Products, availability, and support are for the most part good. And doing this well costs real money.
However, this is offset by anticompetitive practices behind the scenes. Yes businesses compete, but cut-throat competition stifling stuff is gross, and in the end hurts the consumer.
Itās simple. When you place a product, try to stay a bit clear and make your stuff a bit different. The more distance you keep, the more secure you are. Designs donāt need to be terrible different to be in the green zone.
You donāt know what has been published to optain certain rights, so better keep a bit more distance if you want to be sure not to breach. There are also other laws like fair competition laws in place.
You design is just box. It not protect because is not original. You having no real protection of this design just name āvescā which you license for bully other. You want make threat to other because of a box. ![]()

I canāt help but feel like youāre avoiding my more direct questions on this. I appreciate you taking the time to answer, but I donāt want to waste both of our time repeating myself if you donāt want to answer the questions. Youāre fully within your right to decline to answer. Iām legitimately just trying to gain understanding.
To me this looks like its almost purposefully being obfuscated to keep people worried, when it doesnāt need to be like that, especially on an open source project. So Iāll ask once more, questions in bold.
You said you disclosed several UCDs, on a private āspecialā server?
Iām confused as to how someone without intrinsic industry knowledge would know how to go about discovering any protected designs related to the VESC project.
What was the date these UCDs were disclosed?
You donāt have to answer, but Iād prefer you to decline to answer rather than avoid the question. Not trying to disrespect your time.

Oh boy I did it again, dying here cracking myself up.
Thatās all ok and everything what you wrote above but thing is that should we have double standards?
I asked about this few times now so I ask again. How is it so bad that stewii made his ESCape similar to Vesc 6 and this is ok?

Is really Frank presence here for listening customer or more protecting Trampa business? If he wouldnāt be here he wouldnāt know about ESCape so fast. Maybe it would develop into something else. There were more duals than singles so another direct question to Frank. If stewii decide to do only duals would it be ok from your highly subjective perspective?
A lot in this discussion is about Vesc trade mark again which is not the point here.
That is far too subjective be legally valuable. There is no defined value for āa bitā.
A good act doesnāt erase a bad act, itās not a total value consideration. The facts make plain that Frank is a bully (refer to the email to stewii), there is NO registered design so Frank as a liar (many people have looked, none have found it).
And response
Im happy someone else brought up the ABEC Flywheels vs all the other clones.
Double standards
and this one too
I dont disagree with you. Thatās what my post was about.
It was also about the possibility of this being let go or having some end in sight. Is this just going to be a running theme in DIY esk8 forever?
for people not so long in the community this is valuable information, im glad it was brought to my attention⦠
but i understand your point aswell
Itās a Trampa
As I said before, once a product is public in Europe, you gain a design right, if you like it or not.
If you write code and publish it, you gain a copyright, if you like it or not.
You canāt give away a copyright, even if you wish to do so. It sticks to your person with the ultimate superglue. The GPL works around that fact via a trick, a free license. Copyright is valid as long as you live and even beyond that point, designs go after 3 years. Certain designs may stay beyond your death.
Think about Bauhaus classic furniture.
The third party must stay clear of such rights obtained. As a competing business you donāt know what exactly has been published, but you should assume that the design has been published in a way that it covers all colours (by publishing line graphics or variations in colour or greyscale gradients). In consequence you design your device a bit different, which you should do anyway as a matter of fair play.
As as I can judge you, you wouldnāt purposely copy an existing design, would you? You know the reason and know itās wrong. It would not happen to you, regardless of the IP of others. You are innovator and would gain zero satisfaction by copying an existing design.
With regards to OS and design rights. For me and Benjamin OS is predominantly about spreading knowledge about technology and share this knowledge with others. We both do not like straight copy paste stuff, we both like innovations and innovative products. Benjamin would never ever clone a product or a software. He would always do his own thing because he likes the challenge and likes to learn new stuff by working himself into the matter. For Vedder Open Source is not predominantly about making a certain technology available free of charge, it is about sharing the knowledge about that tech, so that we all can learn from another and use that technology in our own products/projects in a re-mixed way. Re-mixed with your own ideas and thoughts.
However, design and tech are two different pairs of shoes. The same technology can come in different dresses and it actually should be like that to allow users to separate different products from another in their mind. A design is not blocking anyone to make a very similar product with a different design. It is quite important to differentiate between designs, copyrights, trademarks and patents. OS is predominantly about copyright and patent relevant stuff, not about trademark and design stuff. A trademark is the identity in trade, designs also have to do with identity and can be simple, complex or iconic. A certain design is usually associated with a brand or a country or group.
UCD servers are available, you can use them or choose to publish elsewhere. You can also use your own website and do screenshots or ask others to do so in order to proof multiple sources. That all doesnāt matter since that is not relevant to the fact that a design is yours once it is public (at least for 3 years).
You also do not need to know all published designs to stay clear. Chances that you breach someoneās rights if you design your stuff yourself are almost zero.
If you like you can ring my skype and I can explain you some stuff, digging a bit deeper. Iām happy to share that knowledge and my opinion.
Love how the truth is coming out hereā¦
Mike isnāt a zealot, but a warrior for truth.
The Barrels are an existing product. It has not been invented by any esk8 outfit. They exist for a long time in other markets. That is applying tech to tech, and has nothing to do with design. We all use belts or gears, do we?
With regards to the Stickies: I agree on that point and probably I would not buy those wheels any more. We didnāt design them, we purchased them in a low quantity. 99% of the boards we sell have pneumatics and PU is not our territory really. Even if the ABEC 11 flywheel has no design rights attached to it, I would probably go for a new design anyway. Chris Chaputs major problem is his brand since ABEC in combination with wheels is commonly used.
Holy fuck you sound like a broken record.
I think everyone gets there are design rights on published designs. Whatās not clear here is where are you publishing these designs? How can people check they are not copying these designs? How can anyone validate your claims about your design rights?
Is a non dated screenshot of your own private server enough to claim design rights?
A screenshot usually shows the date and if you have friends doing the same shot that is a good proof already. You can also upload to servers.
How can people check they are not copying these designs?
They look at the device and imagine it in line graphics.
